The Rules That Apply Here.

These Terms of Service govern all painting, restoration, and coating contracts entered into with Elegant Prime Painting (ABN: 98 297 138 462, QBCC Licence: 15391993). By accepting an official written quote or authorizing work on-site, you agree to these commercial terms.

1. Written Quotations and Scope of Work

All quotations provided by Elegant Prime Painting are valid for 30 calendar days from the date of issue. Quotations are based on a physical on-site inspection or detailed architectural plans provided by the client. Any additional work requested outside the documented scope of work will be confirmed via a written variation and agreed upon prior to execution.

2. Surface Preparation and Hidden Defects

While our team carries out comprehensive visual inspections, certain substrate defects (such as concealed structural timber rot, internal plumbing moisture, or delaminating historic plaster) cannot always be detected prior to washing or stripping. If hidden defects are uncovered, our project director will immediately notify the property owner with rectification options and transparent cost breakdowns before proceeding.

3. Site Access and Household Safety

The client agrees to provide safe, unobstructed access to the work areas during agreed operational hours (Monday to Friday, 07:00 to 17:00, or agreed weekend/night schedules for commercial jobs). Power and water connections must be available on-site for preparation equipment.

4. Payment Terms

Unless otherwise specified in a commercial trade agreement:

• Residential projects: A standard deposit is required upon booking confirmation, with progress payments staged according to completed milestones and final balance due upon final walk-through inspection.
• Commercial projects: Progress claims are submitted in accordance with the agreed schedule of values and payable within 14 calendar days.
• Accepted payment methods include Bank Transfer, Visa, Mastercard, EFTPOS, and Cash.

5. 5-Year Workmanship Warranty

Elegant Prime Painting provides a 5-Year Workmanship Warranty against peeling, flaking, or blistering resulting from application defects on all architectural coatings. This warranty excludes normal atmospheric wear, structural building settlement cracks, external mechanical impact, water damage from subsequent plumbing/roof leaks, or homeowner neglect.

6. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Queensland, Australia. The parties submit to the exclusive jurisdiction of the courts of Queensland and the Queensland Civil and Administrative Tribunal (QCAT).
